TERMS AND CONDITIONS
1. Parties, Definitions and Scope
These Terms and Conditions (“Terms”) govern the use of the website located at www.mysamoon.com and all related digital services (collectively, the “Website”), operated by MYSA MOON MODA TASARIM TEKSTİL ÜRÜNLERİ SANAYİ VE DIŞ TİCARET LİMİTED ŞİRKETİ (“Mysa Moon”), and any natural or legal person who visits the Website, creates an account or places an order through the Website (the “User”).
A User purchasing products through the Website may also be referred to as the Customer or, where applicable under consumer protection legislation, the Consumer.
By visiting the Website, creating an account or placing an order, the User acknowledges that they have read and accepted these Terms.
Detailed provisions regarding orders, payments, delivery, the right of withdrawal, returns and exchanges are separately set out in the Preliminary Information Form, the Distance Sales Agreement and the Shipping, Returns and Exchanges Policy. Mandatory consumer protection legislation shall remain applicable.
2. Use of the Website
The User agrees to use the Website solely for lawful and personal purposes.
The User shall not:

interfere with the operation, servers, software or security systems of the Website;

upload viruses, malicious software, code or similar harmful content;

engage in activities that may interrupt or impair the operation of the Website;

access the Website or place orders through automated software, bots, scraping tools or similar technologies;

use another person’s account or payment information without authorisation;

provide false, misleading or inaccurate information;
-
misuse promotions, discounts, gift vouchers or campaign benefits;
-
infringe the intellectual or industrial property rights of Mysa Moon or any third party.
Where unlawful use, suspected fraud, security risks or misuse of the Website is detected, Mysa Moon may suspend the relevant transaction, review the order and implement appropriate security measures. The Consumer’s statutory rights shall remain reserved.
3. Membership
Creating an account is not mandatory in order to place an order through the Website. Users may, however, create an account to benefit from membership services.
The User is responsible for ensuring that all information provided during registration is accurate, complete and up to date. Any changes should be updated through the User’s account.
The User is responsible for maintaining the confidentiality of their username, password and account information. If any unauthorised use of the account is detected, the User must promptly notify Mysa Moon.
Membership accounts may not be transferred to or used by third parties.
Mysa Moon may temporarily suspend or terminate a membership account where unlawful use, suspected fraud, security risks or a breach of these Terms is identified.
The User may request the closure of their account at any time. Closing an account shall not affect pending orders, statutory record retention obligations or rights and obligations accrued before the closure.
4. Products and Product Information
Mysa Moon exercises reasonable care to ensure that product descriptions, images, sizing information, product specifications and prices displayed on the Website are accurate and up to date.
However:

colours may vary slightly depending on screen settings and display devices;

minor variations arising from fabrics, craftsmanship, manufacturing techniques or the nature of the product may occur;
-
reasonable measurement tolerances may exist as a natural consequence of the production process.
Product images are intended to illustrate the general appearance of the product. Essential characteristics, materials, sizing information and any special care or usage instructions are specified on the relevant product page.
The Consumer’s statutory rights relating to defective products remain reserved.
5. Made to Order Products
Products marked “Made to Order” on the relevant product page or during the ordering process enter production after the order has been confirmed.
Such products are prepared in standard size options and do not constitute personalised or bespoke products.
The estimated delivery period for Made to Order products is 7–15 business days from the date the order is confirmed.
The delivery process and the rights and obligations relating to Made to Order products are further governed by the Preliminary Information Form, Distance Sales Agreement and Shipping, Returns and Exchanges Policy.
6. Order Placement
Adding a product to the shopping cart does not constitute completion of an order nor reserve the product for the User.
An order is created once all required information has been entered, payment has been successfully completed and the order has been received by Mysa Moon’s systems.
The automatic confirmation e-mail confirms only that the order has been received. If stock availability, payment verification, security checks, technical issues or obvious pricing errors prevent the order from being processed, the Customer shall be informed accordingly.
Mysa Moon does not cancel orders arbitrarily. However, an order may be cancelled where:
-
payment has not been successfully completed or authorised;
-
circumstances objectively prevent production or delivery;
-
an obvious pricing or system error has occurred;
-
fraud, unauthorised payment or suspicious activity is detected;
-
incorrect delivery or contact information prevents fulfilment of the order;
-
promotions or discount campaigns have been misused; or
-
a force majeure event occurs.
Where an order is cancelled, any payment received shall be refunded in accordance with applicable legislation and the relevant payment provider’s procedures.
7. Prices, Taxes and Payment
Unless otherwise stated, prices displayed for sales within Türkiye are shown in Turkish Lira (TRY) and include the applicable Value Added Tax (VAT).
Shipping charges or any additional fees, where applicable, are displayed before the order is completed.
Mysa Moon reserves the right to amend prices and promotional campaigns prospectively. Such changes shall not affect completed orders.
Orders placed due to obvious pricing or typographical errors that would clearly be recognised by an average consumer as erroneous may be cancelled. In such cases, the Customer shall be informed and any payment received shall be refunded.
Payments are processed through authorised payment service providers available on the Website. Mysa Moon does not necessarily store complete payment card details on its own systems.
8. Security and Product Protection Tag
Products may be delivered with a Security and Product Protection Tag to support quality control, assess the condition of the product and preserve its integrity.
The tag is designed not to prevent reasonable inspection or fitting of the product.
Products returned for refund or exchange are expected to be:

unused;
-
unwashed or uncleaned;
-
free from stains, odours and damage;
-
unaltered;
-
returned together with all original accessories, packaging and product labels; and
-
suitable for resale.
Removal, cutting, alteration or damage to the Security and Product Protection Tag shall be taken into account when assessing the condition, integrity and resaleability of the product.
The removal of the tag alone shall not automatically deprive the Consumer of any mandatory statutory rights. However, where the product has been used beyond what is necessary to determine its nature, characteristics or functioning, or where a loss in value has occurred, the relevant request shall be assessed in accordance with the applicable legislation.
Consumers’ statutory rights relating to defective, faulty or incorrectly delivered products remain reserved.

9. Delivery, Right of Withdrawal, Returns and Exchanges
Delivery, withdrawal, return and exchange procedures are governed by:

the Preliminary Information Form;
-
the Distance Sales Agreement; and
-
the Shipping, Returns and Exchanges Policy.
Nothing contained in these Terms shall be interpreted as excluding or limiting the Consumer’s statutory rights under the Turkish Consumer Protection Law No. 6502 or other applicable legislation.
The preparation of products in standard sizes on a Made to Order basis does not, by itself, constitute an exception to the Consumer’s right of withdrawal.
Where products are specifically prepared in accordance with the Consumer’s individual requests or personal needs, the relevant conditions shall be clearly indicated on the product page and during the pre-contractual information process.
10. Campaigns and Discount Codes
Campaigns, discount codes, gift vouchers and promotional offers are valid only within the scope of the announced terms, products, users and validity periods.
Unless otherwise stated, multiple promotions or discount codes cannot be combined within the same order.
Mysa Moon may invalidate discounts or review orders where campaigns or discount codes are:

shared without authorisation;
-
used by exploiting technical or system errors;
-
used contrary to the applicable conditions through multiple accounts; or
-
used for commercial resale purposes.
The Consumer’s statutory rights remain reserved.
11. Intellectual Property Rights
All intellectual and industrial property rights relating to the Website, including but not limited to its design, software, operation, the Mysa Moon name and trademarks, logos, product and collection names, designs, drawings, patterns, photographs, videos, lookbooks, campaign content, graphics, texts, music, audio content, visual layouts and databases belong to Mysa Moon or the respective rights holders.
None of these materials may be copied, reproduced, modified, published, distributed, sold, licensed or otherwise used for commercial purposes without Mysa Moon’s prior written consent.
Viewing the Website for personal and non-commercial purposes does not grant the User any intellectual or industrial property rights.
12. Personal Data and Cookies
Details regarding the processing, storage, transfer and protection of personal data are provided in the Personal Data Protection Notice (KVKK) and the Privacy Policy.
Information regarding cookies and similar technologies used on the Website is provided in the Cookie Policy.
Commercial electronic communications are sent only where the User’s separate consent is obtained where required by law. Acceptance of these Terms alone shall not constitute consent to receive commercial electronic communications.
13. Third-Party Links and Service Providers
The Website may contain links to third-party websites, payment providers, shipping companies, social media platforms or other digital services.
The inclusion of such links does not imply endorsement by Mysa Moon of any third-party content, services or practices.
Third-party terms and privacy policies may apply. Mysa Moon’s obligations under applicable legislation remain reserved.
14. Website Changes and Service Interruptions
Mysa Moon may modify the content, design or technical infrastructure of the Website for security, maintenance, legal compliance or operational reasons.
Temporary interruptions to the Website may occur due to maintenance, technical failures, internet infrastructure issues, cyberattacks or circumstances beyond Mysa Moon’s reasonable control.
Mysa Moon shall exercise reasonable care to minimise and resolve such interruptions, without prejudice to its statutory obligations.
15. Force Majeure
Natural disasters, fire, floods, earthquakes, epidemics, war, terrorism, strikes, lockouts, governmental decisions, import or export restrictions, transportation or logistics disruptions, power or communication failures, cyberattacks and other similar events beyond the reasonable control of the parties may constitute force majeure events.
Where a force majeure event affects the fulfilment or delivery of an order, the Customer shall be informed within a reasonable period. The parties’ statutory rights shall remain reserved.
16. Amendments to the Terms
Mysa Moon may update these Terms prospectively due to legislative changes, operational requirements, technical developments or improvements to its services.
The updated version shall become effective upon publication on the Website.
The Distance Sales Agreement and Preliminary Information Form in force on the date of the order shall continue to apply to that specific order.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Any invalid or unenforceable provision shall be interpreted as closely as possible to its original intent and applicable law.
18. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Republic of Türkiye.
Disputes arising from consumer transactions shall be subject to the jurisdiction of the competent Consumer Arbitration Committees and Consumer Courts in accordance with the applicable legislation.
For disputes involving Users who do not qualify as Consumers, the provisions relating to the competent courts and enforcement offices under the applicable legislation shall apply.

20. Entry into Force
These Terms and Conditions shall enter into force on the date they are published on the Website.
