         PERSONAL DATA PROTECTION NOTICE (KVKK)

1. Data Controller

This Personal Data Protection Notice has been prepared by MYSA MOON MODA TASARIM TEKSTİL ÜRÜNLERİ SANAYİ VE DIŞ TİCARET LİMİTED ŞİRKETİ (“Mysa Moon”), acting in its capacity as the data controller pursuant to the Turkish Personal Data Protection Law No. 6698 (“KVKK”).

At Mysa Moon, we attach great importance to the security and confidentiality of your personal data. Your personal data is processed in accordance with the KVKK and the applicable legislation within the framework set out below.

2. Personal Data We Process

In connection with the products and services provided by Mysa Moon, the following categories of personal data may be processed:

  • Identity information (name and surname)

  • Contact information (telephone number, e-mail address, shipping and billing address)

  • Customer transaction information (order details, order history, return and exchange records, customer service records)

  • Financial information (limited payment transaction information and payment method details)

  • Transaction security information (IP address, website usage logs and login records)

  • Legal transaction information (records relating to disputes, requests and complaints)

Your payment card details are processed by authorised payment service providers solely for the purpose of securely completing payment transactions. Mysa Moon does not store your complete payment card information.

3. Purposes of Processing Personal Data

Your personal data is processed for the following purposes:

  • Receiving, preparing and delivering orders;

  • Processing payment transactions;

  • Issuing invoices and carrying out accounting processes;

  • Providing return, exchange and after-sales support services;

  • Managing customer relations and communication activities;

  • Fulfilling legal obligations;

  • Ensuring information security;

  • Protecting legal rights and establishing evidence in the event of disputes;

  • Conducting marketing and promotional activities where your explicit consent has been obtained.

4. Methods and Legal Grounds for Collecting Personal Data

Your personal data may be collected electronically or physically through:

  • our website;

  • membership and order forms;

  • customer services;

  • e-mail;

  • telephone;

  • cookies; and

  • documents obtained in accordance with legal obligations.

Your personal data is processed based on one or more of the legal grounds set out in Article 5 of the KVKK, including:

  • where expressly permitted by law;

  • where processing is necessary for the establishment or performance of a contract;

  • where processing is necessary for compliance with legal obligations;

  • where processing is necessary for the establishment, exercise or protection of a legal right;

  • where processing is necessary for the legitimate interests of the data controller, provided that such processing does not violate the fundamental rights and freedoms of the data subject; and

  • where your explicit consent has been obtained, where required.

5. Transfer of Personal Data

Your personal data may be transferred, to the extent necessary for the purposes stated above, to:

  • shipping and logistics service providers;

  • payment institutions and banks;

  • accounting and financial consultancy service providers;

  • information technology and infrastructure service providers;

  • legally authorised public authorities; and

  • legally authorised private persons or entities,

in accordance with Articles 8 and 9 of the KVKK.

6. Retention and Security of Personal Data

Mysa Moon retains your personal data for the periods required under the applicable legislation and implements appropriate technical and administrative measures to prevent unlawful processing, unauthorised access, disclosure, alteration or loss of personal data.

Upon expiry of the applicable retention periods or where the purposes requiring the processing of personal data no longer exist, personal data shall be deleted, destroyed or anonymised in accordance with the applicable legislation.

7. Your Rights Under the KVKK

Pursuant to Article 11 of the KVKK, you have the right to apply to Mysa Moon in order to:

  • learn whether your personal data is being processed;

  • request information if your personal data has been processed;

  • learn the purpose of processing and whether it is used in accordance with that purpose;

  • learn the third parties to whom your personal data has been transferred, whether domestically or abroad;

  • request the correction of incomplete or inaccurate personal data;

  • request the deletion or destruction of your personal data under the conditions set forth in the KVKK;

  • request notification of such correction, deletion or destruction to third parties to whom the personal data has been transferred;

  • object to any outcome against you arising from the analysis of your personal data exclusively through automated systems; and

  • request compensation for damages arising from the unlawful processing of your personal data.
