DISTANCE SALES AGREEMENT
1. Parties
This Distance Sales Agreement (“Agreement”) has been concluded electronically between:

And the person placing an order through www.mysamoon.com (the “Website”) (the “Buyer”).
2. Subject of the Agreement
The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale, payment and delivery of the product(s) ordered electronically by the Buyer through the Website.
This Agreement has been prepared in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
3. Products Covered by the Agreement
Before the completion of the order, the Buyer is informed of the following details relating to the product(s):

size;
-
colour;
-
quantity;
-
sale price;
-
payment method; and
-
delivery details.
By confirming the order, the Buyer is deemed to have accepted all such information.
4. Order Placement
Before completing an order, the Buyer has the opportunity to review the essential characteristics of the product, the sale price, the payment method, the delivery period, delivery costs and all other pre-contractual information.
The order is created once the Buyer completes the payment process and provides the required electronic confirmations.
Following the successful placement of the order, the Buyer will receive an electronic confirmation acknowledging receipt of the order.
5. Price and Payment
Unless otherwise stated, all prices are stated in Turkish Lira (TRY) and include the applicable Value Added Tax (VAT).
Payments are processed through the secure payment methods available on the Website.
Orders placed due to obvious system or pricing errors may be cancelled after informing the Buyer. If any payment has already been collected, the relevant amount shall be refunded to the Buyer in accordance with the applicable legislation.
6. Delivery
The ordered product(s) will be delivered to the delivery address specified by the Buyer during the ordering process.
For products marked “Made to Order” on the relevant product page or prior to the completion of the order, the estimated delivery period is 7–15 business days from the date the order is confirmed.
For products not carrying this notice, the delivery period shall be as stated on the relevant product page.
Should delivery be delayed due to force majeure events or circumstances beyond the Seller’s reasonable control, including but not limited to governmental decisions, natural disasters, epidemics, transportation disruptions or extraordinary logistics conditions, the Buyer shall be informed accordingly.
For international deliveries, delivery times, shipping conditions and customs procedures may vary depending on the destination country. Unless expressly stated otherwise, any import duties, customs duties, taxes or similar charges shall be borne by the Buyer.
7. Right of Withdrawal
Where the Buyer is entitled to a right of withdrawal under the applicable legislation, the Buyer may exercise such right within 14 (fourteen) days from the date of delivery without providing any reason.
The procedures governing the exercise of the right of withdrawal, the circumstances where such right cannot be exercised and the applicable return procedures are set out in the Preliminary Information Form and the Shipping, Returns and Exchanges Policy, both of which are presented to the Buyer together with this Agreement.
8. Returns and Exchanges
Requests for returns and exchanges shall be evaluated in accordance with the applicable consumer legislation and the provisions of the Mysa Moon Shipping, Returns and Exchanges Policy.
Products returned for exchange or refund must be carefully packed together with their original packaging and, where applicable, all accessories, in a manner that prevents damage during transportation.
The Buyer shall be responsible for any loss in value resulting from attaching shipping labels directly onto the original packaging, applying adhesive tape or otherwise damaging the original packaging in a manner that adversely affects the product’s resaleability.
Specific provisions regarding the Security and Product Protection Tag and Made to Order products are separately regulated under the Shipping, Returns and Exchanges Policy.
9. Defective Products
Where a delivered product is found to be defective, the Buyer’s statutory rights under the Turkish Consumer Protection Law No. 6502 shall remain reserved.
10. Force Majeure
Natural disasters, fire, war, epidemics, strikes, transportation interruptions, governmental decisions or any other circumstances beyond the reasonable control of the parties shall constitute force majeure events.
Where obligations cannot be fulfilled due to a force majeure event, the Seller shall inform the Buyer within a reasonable period.
11. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the Republic of Türkiye.
Any disputes arising out of or in connection with this Agreement shall be subject to the jurisdiction of the competent Consumer Arbitration Committees and Consumer Courts in accordance with the applicable legislation.
12. Entry into Force
The Buyer declares that, prior to completing the order, they have read this Distance Sales Agreement electronically, understood its contents and accepted all of its provisions.
This Agreement shall enter into force upon the Buyer’s electronic approval.
